Pro Gym Supply's Warranty Information

Pro Gym Supply, Inc warrants all that our Serviced & Cleaned and Certified-Pre-Owned products to be free from defects in materials and manufacture for the warranty periods set forth below. The warranty periods commence on the date of delivery. This warranty applies only against defects discovered within the warranty period and extends only to the original purchaser of the product. Parts repaired or replaced under the terms of this warranty will be warranted for the remainder of the original warranty period only.
“As Is” Sale: The Equipment is sold “as is” and “where is,” without any expressed or implied warranties, except that the Equipment is free and clear of any liens or encumbrances
Serviced & Cleaned: Pro Gym Supply hereby provides Customer a thirty-day or ninety-day warranty on parts depending on what is stated on the invoice; the warranty shall commence on the date the Equipment is delivered or received by the Customer. This limited warranty does not cover normal wear and tear of the Equipment. This limited warranty cannot be extended.
International Warranty Support (Outside USA)
If you are located outside of the USA, you receive a Parts Warranty only depending on what is stated on the invoice. Pro Gym Supply will send out the replacement parts at our expense. In some instances we will request that the customer ship back any defective or used parts back to us. Pro Gym Supply reserves the right to request a refundable core deposit for expensive components like electronics or motors. Once the defective core is returned to us we will refund/release the hold on the credit card.
Parts Include All mechanical systems and electrical systems. Motors, wires, switches, control panels, motor control circuit boards, and other moving parts are covered by PGS Warranty. All electronics including the motor are not covered if the Customer neglected preventative maintenance such as waxing decks. Pro Gym Supply may at its discretion use new, used, refurbished, or rebuilt parts as it deems necessary to fix your machine. Replacement parts may be OEM, aftermarket, or custom made depending on the need. Pro Gym Supply reserves the right to request maintenance records for all equipment under warranty.
Parts do NOT include plastics, covers, shrouds, or cosmetic components. If the plastics break during the warranty period it is the responsibility of the buyer to replace them at their expense. However, if the plastics are missing or defective on delivery, Pro Gym Supply will send them to you at no charge.
“Used” Integrated or attachable LCD or Personal Viewing Screens (PVS) are EXCLUDED from all PGS warranties and therefore NOT covered under warranty. The only guarantee offered to the Customer is that the PVS/LCD screen is guaranteed to work on arrival. Pro Gym Supply’s liability and responsibility for the PVS screen ends 24 hours after the product was received.
Labor Includes: Cost to send a repair technician to the location to service the products. The location of the products must be registered with Pro Gym Supply on the invoice.
If the location changes please notify Pro Gym Supply in writing. If you are moving or relocating the equipment, Pro Gym Supply reserves the right to request proof that the equipment was moved by a qualified company or technician to ensure the transferability of the warranty to your new location.
Conditions & Restrictions
This Warranty is valid only in accordance with the conditions set forth below:
The warranty applies to the products only while a. it remains in the possession of the original purchaser and proof of purchase is demonstrated, b. it has not been subjected to accident, misuse, abuse, improper service c. claims are made within the warranty period.
This warranty does not cover damage or equipment failure caused by electrical wiring not in compliance with electrical codes or manufacturers owner’s manual specifications, or failure to provide reasonable and necessary maintenance as outlined in the owner’s manual.
Pro Gym Supply will NOT reimburse a customer for warranty service & repairs not scheduled by Pro Gym Supply unless authorized by a Pro Gym Supply representative in writing with an agreed price.
Although we try to expedite each service call, Pro Gym Supply cannot be held responsible for parts backorders or the availability of service technicians in your local area.
This Limited Warranty shall NOT apply to:
- Software version upgrades.
- Normal wear and tear, consumables, and cosmetic items, including, but not limited to the following: grips, seats, labels, upholstery.
- Service calls to correct installation of the equipment or instruct owners on how to use the equipment.
- Pickup and delivery involved with repairs.
- Any labor costs incurred beyond the applicable labor warranty period.
Disclaimer & Release
The warranties provided herein are the exclusive warranties given by Pro Gym Supply and supersede any prior, contrary or additional representations, whether oral or written.
Any implied warranties, including the warranty of merchantability or fitness for a particular purpose that apply to any parts described above are limited in duration to the periods of express warranties given above for those same parts. Pro Gym Supply hereby disclaims and excludes all other obligations or liabilities, express or implied, arising by law or otherwise, with respect to any nonconformance or defect in any product, including but not limited to (a) any obligation, liability, right, claim or remedy in tort, whether or not arising from the negligence of Pro Gym Supply or its suppliers (whether active, passive or imputed) and (b) any obligation, liability, right, claim or remedy for loss of or damage to any equipment.
Exclusion of Consequential and Incidental Damages
Pro Gym Supply and/or its suppliers shall have no obligation or liability, whether arising in contract (including warranty), tort (including active, passive, or imputed negligence and strict liability), or otherwise, for damage to the equipment, property damage, loss of use, revenue or profit, cost of capital, cost of substitute equipment, additional costs incurred by buyer (by way of correction or otherwise) or any other incidental, special, indirect, or consequential damages, whether resulting from non-delivery or from the use, misuse or inability to use the product.
Warranty Claim Privilege
The warranty is only valid and applicable when the invoice has been paid in full. If there is an open balance or outstanding balance due on the account the warranty will not be supported until this invoice is paid or at the discretion of Pro Gym Supply management; however, the warranty period begins on the day the Customer received delivery of the merchandise.
For any product described below that fails to conform to its warranty or in instances where the product is deemed defective or unserviceable, Pro Gym Supply will provide, at their option, one of the following: (1) repair; (2) replacement; (3) refund of the purchase price not including original shipping charges; or (4) issue the Customer store credit for the full value of the merchandise which can be applied towards the purchase of any good or service that Pro Gym Supply offers.
