Pro Gym Protection Plan Warranty on Gym Equipment

At Pro Gym Supply, we’re committed to providing you with top-notch commercial gym equipment tailored to your needs. Understanding the significance of dependability and peace of mind when investing in fitness gear, we ensure extensive warranty options across our range.

Warranty Types

Manufacturer's Warranty

Each piece of our new equipment includes an OEM Warranty from its Original Equipment Manufacturer, safeguarding your purchase. Since details and durations vary by model and maker, we recommend reviewing the warranty info on each product page and consulting the manufacturer’s website for up-to-date specifics.

3-Year Parts & Labor

Covered under the Pro Gym Protection Plan, this warranty offers 3 years of parts and labor coverage, beginning 30 days post-purchase. It reflects our trust in our equipment’s quality and longevity. Customers can also opt to extend their warranty up to 5 years for even more comprehensive protection.

While we ensure the quality of our equipment, CPS stands ready to efficiently and effectively handle any claims, providing seamless and hassle-free support.

None: As Is, Where Is

Items sold with no warranty are offered to ensure maximum value, priced at our lowest to benefit our customers. Ideal for those opting to pick up directly from our distribution centers, these products are provided “As Is, Where Is,” meaning they come without any warranty, expressed or implied. This condition offers substantial savings, acknowledging that the buyer accepts the item in its current state, understanding its condition and functionality without any guarantees from Pro Gym Supply. This approach allows us to extend exceptional deals to our customers, while ensuring transparency and clarity regarding the nature of the purchase.

International Warranty Support (Outside USA)

Pro Gym Supply, valuing our international customers, offers a Parts Warranty detailed specifically on your final invoice. It’s crucial to understand that warranties do not imply at the initial sale; explicit discussion and clear statement on the invoice are necessary for validity. Pro Gym Supply takes the initiative to send replacement parts at our expense, but in certain cases, may require customers to return any defective or used parts at their expense. Customers bear full responsibility for all taxes, tariffs, and additional charges on international parts shipments.

When shipping costs exceed 50% of a part’s value, we require customers to cover these expenses. Additionally, Pro Gym may request a refundable “core deposit” for high-value components like electronics or motors, refunded upon the defective part’s return.

Unfortunately, extended warranties are unavailable for international orders. Despite this, our commitment to quality and customer satisfaction remains unwavering, although logistical and regulatory complexities prevent the offering of extended warranty services internationally.

Warranty Coverage

The warranty comprehensively covers parts and labor for repairs, targeting internal hardware failures and manufacturer defects.

On-Site Repairs

We ensure repairs are carried out in both home and commercial settings by deploying technicians to restore your equipment functionality. Replacement parts provided under warranty may be OEM, aftermarket, or custom-made, depending on availability and the specific needs of the repair.

Continuation of Coverage

Coverage remains active until the Contract’s end, but concludes if the equipment is replaced under warranty or if repairs costs surpass the original purchase price.

Resolution for Irreparable Equipment

Unrepairable equipment will result in compensation based on its current market value, ensuring you are fairly reimbursed.

Exclusions

  • Personal Viewing Screens: Integrated or attachable LCD or PVS “used” units are excluded from all warranties, with an operational guarantee upon arrival only. Our responsibility for the PVS/LCD screen expires 24 hours after delivery. CPS may handle claims for manufacturer defects.
  • Cosmetic Damages: Minor cosmetic imperfections may exist on pre-owned and refurbished items due to their pre-used nature, which are not covered unless specifically mentioned in the sales documentation. This exclusion covers plastics, covers, shrouds, or other cosmetic parts. Buyers are responsible for replacing any “plastics” that break during the warranty period at their expense, through either Pro Gym or the OEM. Should plastics arrive missing or defective, Pro Gym Supply will provide replacements at no charge.
  • Equipment Relocation: Inform Pro Gym Supply about any equipment relocation. We may request evidence that a professional service or qualified technician conducted the move to maintain warranty validity at your new location.
  • Software Updates: Software updates for fitness equipment (e.g. consoles, controller boards) are not included under this warranty. Customers requiring software updates should directly contact the manufacturer, who will provide the necessary files and detailed instructions for the update process. Typically, this involves downloading update files from the manufacturer’s website, transferring them to a USB drive, and then plugging the USB into the equipment to complete the update.

Conditions & Restrictions

This Warranty is valid only in accordance with the conditions set forth below:

  • Eligibility: Applicable to the original purchaser or transferred owner, provided there is necessary prof of purchase or transfer documentation. The warranty is transferable to a new owner for a $25 fee. For assistance with warranty transfer, please contact Consumer Priority Service (CPS) toll-free at 800-905-0443. Transferability of manufacturer warranties depends on OEM terms and conditions.
  • Use and Maintenance: The product must not be misused, abused, improperly services, and should adhere to electrical codes and manufacturer guidelines, including prescribed maintenance as outlined in the Owner’s Manual.
  • Warranty Claims: You must lodge all claims within the designated warranty period.

Exclusions

This Warranty does not cover:

  • Damage due to non-compliance with electrical codes or maintenance instructions in the Owner’s Manual.
  • Normal wear and tear and consumables, including but not limited to the following: grips, seats, labels, upholstery.
  • Physical, cosmetic, liquid, or impact damaged, equipment sold with preexisting conditions, or equipment that is lost or stolen.
  • Correct poor installation of equipment or instruct the Owner on how to use the equipment.
  • Pickup and delivery involved with repairs.
  • Any labor or parts costs incurred beyond the applicable warranty period.

Disclaimer & Release

The warranties herein, offered by Pro Gym Supply, are exclusive and override any previous representations, be they oral or written. These constitute the only warranty agreement between Pro Gym Supply and the purchaser.

Implied warranties, if any, including warranties of merchantability or fitness for a particular purpose, are confined to the duration of these express warranties. Pro Gym Supply disclaims all other liabilities or obligations, express or implied, related to product nonconformity or defects. This includes:

  1. Any liability or claim in tort, regardless of negligence, by Pro Gym Supply or its suppliers.
  2. Any liability for equipment loss or damage, including indirect or consequential damages.

By purchasing and using Pro Gym Supply’s products, the purchaser releases Pro Gym Supply and its suppliers from any claims related to the product’s purchase, use, or performance, including direct, indirect, or punitive damages.

Exclusion of Consequential and Incidental Damages

Pro Gym Supply, along with its suppliers, shall not be obligated or liable, under any circumstances, including but not limited to contract (including warranty), tort (whether active, passive, or imputed negligence, and including strict liability), or any other legal or equitable theory, for any direct or indirect damages. These include damages to the equipment, property damage, loss of use, loss of revenue or profit, cost of capital, cost of substitute equipment, or for any additional costs incurred by the buyer (whether by correction or otherwise). Furthermore, Pro Gym Supply and its suppliers are not liable for any other incidental, special, indirect, or consequential damages that may arise, whether resulting from non-delivery of the product, or from its use, misuse, or inability to use the product, under any theory of liability whatsoever.

This limitation on liability is a crucial element of the agreement between Pro Gym Supply and the purchaser, reflecting a deliberate and equitable allocation of risk. The terms outlined herein, designed to limit Pro Gym Supply and its suppliers’ liability, shall remain in effect and enforceable to the fullest extent permitted by law, enduring beyond the termination or expiration of the warranty period provided with the product. By purchasing and using the equipment from Pro Gym Supply, the buyer acknowledges their understanding and acceptance of these limitations as a fundamental part of their purchase agreement.

Warranty Claim Privilege

This Warranty Claim Privilege is conditioned upon the complete fulfillment of payment obligations by the purchaser. The warranty becomes valid and enforceable only when the invoice related to the purchased equipment has been paid in full. In the event of an open or outstanding balance on the account, warranty support shall be withheld until such time as the balance is cleared. The decision to enforce this condition rests solely with the discretion of Pro Gym Supply management.

Notwithstanding the above, it is important to note that the warranty period commences 30 days following the receipt of the deposit. This initiation period is independent of the payment status of the overall invoice and is designed to offer a grace period for warranty activation, while still ensuring that Pro Gym Supply’s policies on payment completion are adhered to.

Exclusive Remedies

In instances where products are covered under warranty and present issues, Consumer Priority Service (CPS) will offer remedies. Should a product remain non-compliant with its warranty, or be deemed defective or unserviceable, and if Pro Gym Supply chooses to intervene, at its sole discretion and as mandated by law, customers are provided with several resolution options. These include (1) repair, (2) replacement, (3) refund of the purchase price (excluding shipping costs), or (4) issuance of store credit for the full value of the merchandise, applicable towards any goods or services Pro Gym Supply offers.

Additionally, it’s important to note that Pro Gym Supply does not offer any warranty or guarantee for equipment still under OEM warranty. In such cases, all remedies are deferred to the Original Equipment Manufacturer (OEM), ensuring that customers receive support directly from the source of manufacture, according to the terms and conditions of the OEM warranty.
